How to reclaim training fees from a leaver

Organisations often make an investment in staff training programmes and courses to develop skills which are valuable to both the employee and the organisation.  The organisation of course wants to see the benefit of that training and therefore the question can arise as to whether the employee can be asked to repay the cost of the training if they leave the organisation. 

Unless there has been a written agreement that reclaiming of training fees will be implemented in the event of leaving, no deduction or request for repayment can be made from an employee.  Any deduction made without this specific agreement would be classed as an unlawful deduction of wages. 

We recommend that you use our Training Indemnity Agreement(available from Doc Spot) for each fee based training activity that you put in place for an employee so that you can protect the organisation’s investment. 

Agreements normally reduce the cost to be repaid to the employer over a gradual period to recognise that the organisation has received some benefit of the employees training.
